Members will be aware that changes to the Construction Act came into force in England and Wales on 1 October
and will come into force in Scotland on 1 November. This has meant that CIAT has amended some of its
Information Sheets, in particular those relating to adjudication.
The original Construction Act was amended by the Local Democracy, Economic Development and Construction Act
2009. It will be necessary to be familiar with both Acts for some time since the original Construction Act will
still apply to those contracts entered into before these dates.
The Institute has updated both the Adjudication Information Sheet and the ADR Information Sheet, both of which
can be downloaded from the Practice Resources section of CIAT’s website(members only). In addition, a
free contract administration form, ‘Payer’s Notice to Payee to Pay Less’, has been introduced with the
basics of the legislation accompanying it to assist members in administering this notice (previously known as
‘Notice to Withhold Payment’). A further information sheet ‘The Construction Act 2011’ has also been
introduced. Members who use the Contract Administration Forms should be aware that there is one amendment to
the Notice of Adjudication which is to insert 2011 after ‘Scheme for Construction Contracts England and Wales
1998/2011’.
